RERA, Assam

The Real Estate (Regulation and Development) Act, 2016 is an Act of the Parliament of India which seeks to protect home-buyers as well as help boost investments in the real estate industry. The Act establishes a Real Estate Regulatory Authority (RERA) in each state for regulation of the real estate sector and also acts as an adjudicating body for speedy dispute resolution. Government of Assam notified the Assam Real Estate (Regulation and Development) Rules, 2017 on 6th May 2017

Are there any Exceptions from Registering with Authorities

Yes. A project is exempted from registration under RERA if:

1. Land proposed to be developed is less than 500 sq.mt. (inclusive of all phases), or

2. No. of apartments less than 8 (inclusive of all phases), or           3. Received Completion Certificate from the Competent authority i.e. plan sanctioning authority prior to the commencement of the Act, or 

4. For the purposes of renovation or repair or re-development does not involve marketing, advertising, selling or new allotment of any apartment, plot or building, as the case may be under the real estate project
